Should you consider tax court litigation?

Many people here in Massachusetts and elsewhere are under the impression that once they have a first dealing with the IRS regarding their situations, that is the end of the matter. That is not necessarily the case. It may be possible to initiate tax court litigation.

The IRS is not always right. If you believe that you did not receive fair treatment or that the IRS made an incorrect assessment, you may have another way to obtain relief. Tax disputes arise all the time, but you may be one of many who feel there is nothing else that can be done. After a careful review of your situation, it may become clear that you can file a complaint in tax court.

Perhaps you dispute the results of your tax audit or you do not believe you should face a trust fund recovery penalty. Maybe you got into a dispute with the IRS regarding an offshore tax matter. It is also possible that you disagree with a bank levy or wage garnishment. Numerous tax controversies may qualify for litigation before the tax court. Unfortunately, by the time you realized that you needed help, you thought it was too late.

The only way to know for sure whether you should consider tax court litigation may be to consult with an experienced tax attorney. Of course, the best time for such a consultation would more than likely be when the dispute first arises. Like many other Massachusetts residents, you may have felt the situation would resolve itself and not become a major issue. Fortunately, it may not be too late to take additional action.
